Temporary Event Notices (TENS)
Purpose of a Temporary Event Notice
A Temporary Event Notice replaces the old Occasional Licence system and, under the Licensing Act 2003, any individual of 18 years or over can apply for a Temporary Event Notice (TEN) should they wish to hold an event involving any form of licensable activity in a premises that is not already licensed for that activity. Extensions of hours or additional licensable activities in premises that are already licensed can also be applied for using a TEN.
A TEN can be used to apply for an event being held in any premises. The term premises can be used to denote an open space as well as a building.
Licensable Activities
Licensable activities are the sale of alcohol, regulated entertainment and the provision of late night refreshment.
Late night refreshment refers to hot food and drink served between 11 pm and 5 am. Regulated entertainment includes:
* The performance of live music
* The playing of recorded music
* The performance of a play
* The screening of a film
* An indoor sporting event
* A boxing or wrestling match
* Performance of dance or anything similar
* The provision of facilities for making music, dancing and entertainment of a similar description
TEN's are useful for community premises, such as village halls and schools, who wish to hold one-off events, or could be used to extend licensable activities in premises that are already licensed. For example, a premises may only be licensed for regulated entertainment, but wishes to hold an event with the sale of alcohol. A TEN will cover this.
Where alcohol is being sold under a TEN there is no requirement for the person selling the alcohol to be the holder of a Personal Licence.
Limitations of TEN's
The current limits on Temporary Event Notices are:
Maximum number of people at any event at any one time must not exceed 499
Maximum duration of the event must not exceed 96 hours
Maximum number of TENS allowed in a calendar year at any one premises are 12 or a maximum of 15 days, whichever is reached first. Please note that a TEN which covers a period which extends over midnight (for example runs from 5pm on a Friday through to 2 am on the following Saturday) uses up 2 of the available event days.
The Maximum number of TENS that can be served by one person in any calendar year is:
5 for people who do not hold a Personal Licence
50 for people who do hold a Personal Licence
A 24 hour gap must be left between TEN's applied for by the same applicant.
The Licensing Act stated that at least 24 hours between individual TEN's for the same premises would be required. The review of the Secretary of State's Guidance has now clarified this position and it is now possible for a premises to have a TEN without the 24 hour gap, subject to the TEN's being for different events.
Objections to TEN's
A TEN is a Notice that is served on both the Local Authority and the local Police. Only the Police can make an objection to the TEN and can only do so on the grounds of crime and disorder.

Each TEN has accompanying notes attached, which are very useful and should be read before the form is completed. The form should be completed in black ink and block capitals and it is important that some contact numbers are given should the Local Authority or Police need to make contact with the applicant quickly. This way unnecessary delays can be avoided.
The TEN must be served on both the Local Authority and Police giving at least 10 clear working days notice before the event is due to take place. This does not included weekends and bank holidays. If this time frame is not given the TEN will be rejected and you will be unable to hold the event.
Two copies of the TEN must then be served on the Licensing Authority. North Wiltshire District Council's details are given below:

If no objection is received from the Police, within 48 hours of receipt of the TEN, the Licensing Authority endorse a copy of the TEN and return it to the applicant. If an objection is received, or one of the limitations as listed above has been reached, a Counter Notice will be given to the applicant and the event will not be allowed to proceed.
The endorsed copy of the TEN must be kept to hand or prominently displayed at the place of the event should anyone with to see confirmation that the event has been permitted. Failure to produce this copy without reasonable excuse would be an offence.
Fee
The fee for each TEN is £21.00, which must be included with the notice served on the Licensing Authority.
