Enforcement Duties and Compulsory Purchase

If an owner neglects to preserve a listed building the Council may serve a ‘Repairs Notice’.  This specifies the works necessary to preserve the building.  You can appeal against a repairs notice.

If these works are not carried out after two months, the Council may look to buy the property compulsorily. The local Authority may also carry out urgent works to preserve an empty Listed Building from getting worse.  The costs of such works will be recovered from the owner.

Before starting any works of repair or alteration to a listed building, make sure that your contractor or builder is made aware that the building is listed and is given a copy of any listed building consent conditions, together with plans, specifications and any grant conditions that may apply.

Historical information may be available at Wiltshire County Record Office www.wiltshire.gov.uk, the local library or your Civic Society.

Churches and Chapels are usually listed.  If the repair works are controlled by a national scheme they are exempt from listed building consent. (For example: Church of England, Catholic Denomination).  However; Planning Permission may be needed.
