Statutory Nuisance

Statutory Nuisances are dealt with under the Environmental Protection Act 1990. Numerous types of problem can be classified as a Statutory Nuisance, the most common being noise and smoky bonfires.

The following is a list of issues which, if sufficiently severe to be considered prejudicial to health or a nuisance, the Environmental Health Team may be able to deal with under Statutory Nuisance provisions:-
  • Premises
  • Smoke
  • Fumes or gases
  • Dust, steam or smell from industrial premises
  • An accumulation or deposit
  • Animals
  • Noise
  • Ponds, pools ditches gutters or watercourses
If satisfied that a situation is prejudicial to health or likely to cause severe or prolonged interference with the enjoyment of property then the Environmental Health Team will serve an Abatement Notice on the person causing the problem. Failure to comply with the notice is an offence for which the person may be prosecuted in a Magistrates Court. If found guilty the court may impose a fine of up to £20 000 and require that certain works are carried out to abate the nuisance.
