If an applicant has their planning application refused by the Council or they feel that conditions are too onerous, they have a right of appeal to the Secretary of State. In practice, appeals are administered by the Planning Inspectorate and the Secretary of State appoints an Inspector to determine an appeal.
The Planning Inspectorate has produced a booklet called “Guide to taking part in Planning Appeals” and the Council can send one of these on request. On-line information about planning appeals is available through this link to the
planning portal.
In 2007, 76 appeals were received and in that year, 51 were dismissed, 20 allowed and 5 withdrawn.
In 2008 81 Appeals have been received with 34 appeals being dismissed. 11 appeals allowed and 4 withdrawn.
